Article 1 – Application of general terms and conditions
These terms and conditions are applicable in full:
- Via the websites linked to BELION, including: www.les-savons-gourmands.com, les-savons-gourmands.be, www.facebook.com/Les.savons.gourmands, www.instagram.com/les_savons_gourmands and others.
- Via any available computer support.
- Via any direct or indirect sale, via craft markets, trade fairs or fairs, our network of sales outlets, etc.
By customer, we mean any individual or legal entity who comes to visit/place an order/purchase on the aforementioned sites, consult information on any computer medium, or others.
The use of the website, computer or other media is subject to compliance with these terms and conditions.
Without prejudice to the customer’s legal rights under the applicable national consumer protection legislation, the customer states that, by placing an order/making a purchase, he/she is aware of the general terms and conditions of BELION, which he/she accepts. The customer is the only person responsible for actually reading the version of the General Terms and Conditions in effect when he/she places an Order. These terms and conditions always prevail over any terms and conditions of the customer, even if the latter states that they are the only ones valid. The customer’s terms and conditions may never be applicable.
The fact that BELION does not insist on one of the provisions of these terms and conditions being strictly applied may not be regarded as an implied waiver of the rights of BELION under these terms and conditions and shall not prevent BELION from later demanding strict compliance with said provisions.
BELION reserves the right to adapt or modify its general terms and conditions at any time. It is the customer’s responsibility to consult these terms and conditions regularly.
If the customer refuses the Terms and Conditions, he is obliged to refrain from any use of the websites and/or services.
Article 2 – The offer
The offer is shown on the website.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the customer to assess the offer properly. If BELION uses images, these will be a true reflection of the products and/or services offered. Obvious mistakes and obvious errors in the offer shall not bind BELION.
In case of paid use of the offer, the customer will be informed in advance, as well as the applicable conditions, prices and method of payment.
Article 3 – Order-Agreement
You can place an order:
- On our Websites, using the online shop.
- By e-mail: les.savons.gourmands@gmail.com
- By a messaging application: Facebook Messenger or Instagram (Direct Messages).
An distance agreement is concluded when the customer sends the order electronically and makes a full payment. No delivery or reservation will be made until the distance agreement is concluded. The customer is bound by the special and/or general conditions that he has accepted as defined above in Article 1. The order confirmation shall be deemed to be the signature of the operations carried out.
The company BELION reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
Article 4 – Applicable prices
The goods are sold at the prices applicable on the date of the purchase, subject to any price changes as a consequence of changes in government decisions, etc.
All prices are expressed in euros and include VAT but are exclusive of any delivery, shipping or other administrative costs, unless expressly stated otherwise. Any costs for delivery, shipping and/or installation will always be stated separately.
In the event of an order to a country other than Belgium, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of the BELION company. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.
For online purchases, the prices or offers shown on the website apply at the time of the online purchase. Prices indicated in the shop or other (IT support, direct or indirect sales, etc.) may change at any time but are fixed at the time of the order by the customer and acceptance by BELION.
As soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.
Article 5 – Deliveries
BELION undertakes to deliver the products to the delivery address that the customer submitted with his/her order and within 48 working hours upon receipt of full payment.
If this is not possible (because the ordered item is not in stock or is no longer available), or there is a delay for any other reasons, or an order cannot be executed or only partially, then the consumer will be so notified as soon as possible and, in that case, shall have the right to cancel the order without cost or notice of default.
Changes to the order by the customer automatically cancel the pre-set delivery times.
In the case of deliveries by a carrier, BELION cannot be held liable for late delivery due to the unavailability of the customer after several appointment proposals. We cannot be held liable for damages resulting from late delivery or non-delivery by the carrier designated by the company. In these cases, our liability shall be limited to the value of the items, with supporting evidence, which have not been received by the customer.
The delivery obligation of BELION will, subject to proof to the contrary, have been met as soon as the goods have been presented to the customer once.
Article 6 – Time of payment
Validating your order implies for you the obligation to pay the price indicated at the latest at the time of the order.
The payment of your purchases is made by debit/credit card through the secure payment system provided on the website.
If no payment is received within 7 days, BELION shall have the right to cancel the online order, without any compensation or refund being due.
Article 7 – Right of withdrawal
The customer has a cooling-off period of 14 days from receipt of the goods to exercise his right of withdrawal without having to justify his reasons or pay a penalty.
To exercise your right, please inform us of your return by e-mail to les.savons.gourmands@gmail.com using this withdrawal form.
BELION authorises returns under the following strict conditions: the returned goods must be in their original packaging. The products must be in their original, unopened, undamaged and unused condition. In this context, the responsibility of the customer is engaged. Any damage suffered on this occasion may be such as to defeat the right of withdrawal. In accordance with European legislation, you do not have a right of withdrawal on customised and made-to-measure goods, such as “prints”.
The return costs are at the customer’s expense and risk. Shipments “carriage paid by the recipient” and “cash on delivery” will be refused.
If the right of withdrawal is exercised and if the goods have been returned correctly, BELION will refund the sums paid within 30 days of notification of the request, with the possibility of postponing the refund until the goods have been recovered or until the consumer has provided proof of dispatch of the goods.
Article 8 – Guarantee
All products comply with European and Belgian cosmetics legislation.
The safety assessment of the products has been carried out by a qualified safety assessor (without animal testing).
They are all notified to the European Commission via an IT portal called CPNP (Cosmetic Products Notification Portal) and comply with Article 13 of European Regulation (EC) No 1223/2009.
As a manufacturer of cosmetic products established in Belgium, the SPF Public Health, Safety of the Food Chain and Environment is informed of my activity.
The manufacture of the products respects the Good Manufacturing Practices as defined in the standard EN ISO 22716:2007.
Article 9 – Liability
The products offered are in accordance with the European legislation and the Belgian legislation in force. The responsibility of the company BELION can not be held liable in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products you plan to order.
In addition, the company BELION can not be held liable for damages resulting from improper use of the product purchased.
BELION is not responsible for the content of other websites to which customers can be directed via hyperlinks on the website. BELION cannot be held liable for the inaccuracy of the information offered.
Finally, BELION cannot be held liable for any inconveniences or damage inherent in the use of the Internet network, in particular a breakdown in service, external intrusion or the presence of computer viruses.
Article 10 – Applicable law in case of disputes
All contracts that we conclude with our clients are subject only to Belgian law, regardless of where our clients live. In case of dispute, only the court of Namur, Belgium, is competent. If for reasons of international law, another law is applicable, the interpretation of these general terms and conditions shall be understood and applied first and foremost according to the Belgian law on market practices and consumer protection. Only the French language is applicable.
Article 11 – Force majeure
If force majeure makes it impossible for BELION to perform its obligations or unreasonably aggravates same, BELION shall have the right to suspend temporarily or definitively the execution of its obligations in full or in part for the duration of the force majeure without having to give prior notice or to pay any compensation. The following are conventionally regarded as cases of force majeure: war, blockade, uprising, epidemics, natural disasters, strikes or lock-out, fire, flooding, seizure, shortage of means of transport, general scarcity of raw materials or products, restrictions on energy consumption, whether in relation to BELION or one of its suppliers.
Article 12 – Intellectual property
The structure as well as the content of the websites and other computer media, in particular the texts, photographs, images, are the intellectual and exclusive property of BELION and are protected by copyright. Any reproduction, representation, adaptation, translation and/or transformation, in whole or in part, or transfer to another site is prohibited without the prior written consent of BELION.
Violation of all these provisions subjects the offender and all responsible persons to the criminal and civil penalties provided for by law.
Article 13 – Archiving and proof
The BELION company will archive the purchase orders and invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized registers of the company BELION will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
Article 14 – Privacy Statement
BELION attaches great importance to the protection of your privacy and personal data. BELION reserves the right to collect nominative information and personal data about you. They are necessary for the management of your order, as well as to improve the services and information we provide you.
They may also be passed on to the companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment. Within the framework of the European standards on data processing (GDPR), your information may not be transferred or resold to third parties not concerned by the processing of your order, either for information or advertising purposes.
The customer always has a legal right to supplement, correct or delete his/her personal data in whole or in part. BELION undertakes to comply with his/her request within 20 working days.
When the customer contacts BELION, his/her personal data and communications are protected by our duty of confidentiality.
However, the customer consents to his/her name and/or logo being used as references on the website. The customer may protest against this at any time in writing, in which case the statement shall immediately and definitively be removed.
